Government response to consultation on proposed amendments to the Greenhouse Gas Emissions Trading Scheme Order 2020

A joint consultation between the UK Government, DAERA, Scottish Government and Welsh Government (UK ETS authority) was held from 29th July 2021 to 7th September 2021 which sought views on proposed technical changes to The Greenhouse Gas Emissions Trading Scheme Order 2020.

This consultation was called the UK Emissions Trading Scheme: proposed amendments, details can be found here.

In light of the consultation responses received, a Government Response has been complied, below.

Subject to the approval of all 4 devolved parliamentary legislatures, amendments will be made to the 2020 Order. This will be delivered through two amending statutory Instruments (SIs):

  • The Greenhouse Gas Emissions Trading Scheme (Amendment) Order 2021
  • The Greenhouse Gas Emissions Trading Scheme (Amendment) Order 2022

The 2022 Order was previously referred to as Greenhouse Gas Emissions Trading Scheme (Amendment) (No. 2) Order 2021 in the consultation.

The UK ETS Authority  have included a small number of further scheme improvements, following targeted consultation with affected parties.

The UK ETS Authority expects both SIs to be in force no later than 31 March 2022.

Detail of feedback received

The UK ETS Authority received 7 responses that largely do not impact the policy intent of the proposed draft provisions.
